WHEREAS the Declaration provides that owners of lots subject to the Declaration are automatically made members of WESTSIDE AT BUTTERCUP CREEK HOMEOWNER'S ASSOCIATION, INC. (the "Association");

WHEREAS the Association, acting through its board of directors (the "Board"), is authorized to adopt and amend rules and regulations governing the property subject to the Declaration and the operations of the Association pursuant to Article IX, Section 3 of the Declaration and state law; and

THEREFORE, the attached amendment to the Rules has been, and by these presents is, adopted and approved.

  1. One Living Unit (home) per Lot. No more than one "Living Unit" as defined in Article I, Section 15 of the Declaration, shall be built on any Lot. No portion of a Lot as defined may be sold; Lots must only be sold as a whole lots, including all improvements thereon

  2. No further subdivision of Lots. "Lots" as defined by Article I, Section 3 of the Declaration are lots as created by the subdivision plats recorded in the Plat Records of Travis County. Lots may not be further subdivided [1].

  3. Security Measures. Security Measures section of the rules filed of record in document no 2021166423 is amended. Namely, front yard fencing is disallowed. See also Declaration Article X Section 28, prohibiting walls or fencing nearer to the front Lot line than the front building line [2].

[1] Article XII Section 9 of the Declaration reserves the right of subdivision to the original Declarant (developer) of the neighborhood. Such right expired at the time of transfer of each lot from the Declarant to a non-Declarant owner.

[2] The front-yard fencing security measures rule was adopted in response to state legislation that has since been repealed.
